Conditions of participation in the horseradish pleasure package competition

By participating in the competition, the participant accepts the following conditions of participation:

1.organizer

1.1 The organizer of the competition is KOCH'S Meerrettich & Feinkost GmbH, Industriestr. 10, 84347 Pfarrkirchen, represented by the managing directors Michael Durach and Stefan Durach.

1.2 The personal terms used (e.g. "participant") are not to be understood as gender-specific.

1.3 The competition is in no way connected to Facebook and is in no way sponsored, supported or organized by Facebook. The recipient of the information provided by the participants is not Facebook.

1.4 KOCH'S Meerrettich & Feinkost GmbH is responsible for the organization, processing, provision of prizes and distribution of prizes.

2.Participation

2.1 Persons over the age of 18 who are resident in Germany are eligible to participate. Each participant is responsible for the accuracy of his/her data, in particular his/her e-mail address. Participation is only possible in one's own name. Employees of KOCH'S Meerrettich & Feinkost GmbH, all persons involved in the development and implementation of the competition (e.g. agencies, consultants, suppliers) as well as their employees or respective family and household members are excluded from participation. Multiple entries are not permitted in this competition. Users of so-called competition entry services or competition clubs are also excluded. Automatically entered email addresses will be excluded from the competition as soon as KOCH'S Meerrettich & Feinkost GmbH becomes aware of them. 

2.2 The following steps are necessary to participate:

- The participant has accepted these conditions of participation in the competition and the privacy policy of KOCH'S Meerrettich & Feinkost GmbH.

2.3 KOCH'S Meerrettich & Feinkost GmbH reserves the right to exclude from participation any persons who use unauthorized aids to participate in the competition or otherwise attempt to gain advantages for themselves or third parties through manipulation or who violate the conditions of participation in any other way. 

2.4 Participation in the competition is free of charge. Neither participation in the competition nor the chance of winning is dependent on the purchase of goods.

2.5 All participants who take the steps specified in section 2.2 by 22.12.2022 (midnight) ("participation period") will be entered into the competition, unless they are excluded in accordance with section 2.1 or 2.3.

2.6 After the end of the competition, 5 horseradish pleasure packages including Le Creuset® roasters will be raffled off among all participants. The winners will be notified by e-mail on 23.12.2022.

3. implementation of the competition

3.1 . The winners will be chosen at random.

3.2 Winners are obliged to reply to the prize notification within one week. In the reply private message, the winner must provide their postal address for the dispatch of the prize. If the reply is not received or not received on time, the claim to the prize will be forfeited without compensation. 

3.3 In the event of a breach of the conditions of participation, prizes may also be subsequently withdrawn and reclaimed.

3.4 Claims to prizes are not transferable to other persons. Cash payment of non-cash prizes is not possible.

4. granting of rights, exemption

4.1 The participant indemnifies KOCH'S Meerrettich & Feinkost GmbH against all claims that are raised due to the infringement of copyrights, rights of use under copyright law, ancillary copyrights or other rights for which the participant is responsible. The indemnification also includes the costs for a necessary and appropriate legal defense of KOCH'S Meerrettich & Feinkost GmbH.

5.Liability

5.1 Any liability of KOCH'S Meerrettich & Feinkost GmbH for the existence of the technical requirements for timely participation in the competition or the dispatch of the prizes (constant access to the Internet pages on which participation is possible or dispatch of the prizes by the post office and/or transport companies) is excluded.

5.2 KOCH'S Meerrettich & Feinkost GmbH accepts no liability for errors or misprints or for any damage that may arise in connection with the provision and claiming of prizes, insofar as this is legally permissible.

5.3 The above exclusions of liability shall not apply in the event of fraudulent concealment of defects or the assumption of a guarantee of quality, injury to life, limb or health. Liability under the Product Liability Act also remains unaffected. This does not imply a change in the burden of proof to the detriment of the participant.

5.4 Insofar as the liability of KOCH'S Meerrettich & Feinkost GmbH is excluded or limited, this also applies to the personal liability of its employees, workers, representatives, staff and vicarious agents.

5.5 KOCH'S Meerrettich & Feinkost GmbH shall be released from all obligations upon delivery of the prize(s). The winners will be announced without guarantee.

6 Premature termination of the competition

6.1 KOCH'S Meerrettich & Feinkost GmbH reserves the right to cancel or interrupt the competition at any time without prior notice, to end it early or to extend its duration. This applies in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, the proper running of the competition cannot be guaranteed.

6.2 Claims for performance and damages by the participant in the event of premature termination or extension of the competition in accordance with Section 6.1 are excluded within the framework of the provisions of Section 5.3.

7.Data protection

7.1 KOCH'S Meerrettich & Feinkost GmbH as the responsible body within the meaning of the German Federal Data Protection Act collects, processes and uses all personal data provided in the context of this competition in accordance with the applicable data protection regulations. 

The winners must provide KOCH'S Meerrettich & Feinkost GmbH with the following personal data: First name, surname and address.

8.other

8.1 The competition is subject to German law.

8.2 Should any provision of these Terms and Conditions of Participation be or become invalid, this shall not affect the validity of the remaining provisions.

8.3 Legal recourse is excluded.

8.4 The purchase of products and/or services from KOCH'S Meerrettich & Feinkost GmbH has no effect on the outcome of the competition.
